- These Terms of Service apply to all users of PitchWizard, including individual subscribers and Schools. By accessing or using our platform, you acknowledge that you have read, understood, and agree to be bound by these terms and applicable laws and regulations.
3. Account Creation
3.1 Eligibility
- You must be at least 18 years old or have parental/guardian consent to create an account.
- You agree to provide accurate and complete information during the registration process.
3.2 Account Security
- You are responsible for maintaining the confidentiality of your account credentials.
- You must notify us immediately of any unauthorized use of your account or any other security breach.
4. User Responsibilities
4.1 Conduct
- You agree to use the platform for lawful purposes only.
- You agree not to engage in any behavior that could harm the platform or other users, including but not limited to harassment, posting offensive content, or attempting to disrupt the platform’s operations.
4.2 System Security
- You are responsible for maintaining your system’s security. You must not attempt to bypass or undermine the platform’s security measures.
5. Our License to You
5.1 Limited License
- We grant you a limited, non-exclusive, non-transferable license to access and use the PitchWizard platform and its content for personal or organizational educational purposes, subject to these Terms of Service.
5.2 Restrictions
- You may not modify, distribute, reproduce, or use any content from the platform for commercial purposes without our explicit permission.
5.3 Prohibited Activities
- The platform and its content are intended for personal and organizational educational use only. Commercial use or any form of profit-generating activity using the platform without prior written consent from PitchWizard is strictly prohibited.
5.4 Licensing for Commercial Use
- For commercial use inquiries, please contact us for appropriate licensing agreements.
6. Subscription Plans
PitchWizard (Monthly Payment):
- Includes a 3-day free trial.
- Refund requests can be made within the first 7 days.
- Subscribers are charged on the 4th day and may request a refund within the first 7 days.
- Subscribers can cancel anytime.
- Student records for completed programs are retained; progress may be lost upon cancellation.
6.2 School Plans
- Refund requests can be made as per our refund policy.

7. Termination Policy
7.1 For Individuals
- Subscribers can cancel anytime. There will be no refunds for the current billing cycle, and access will continue until the end of the current billing cycle.
7.2 For Schools
- Schools can cancel before the start of an academic semester.
8. Intellectual Property
8.1 Platform Content
- All content on PitchWizard’s Platform is the property of PitchWizard and is protected by intellectual property laws. Unauthorized use of content is prohibited. All content on PitchWizard, including courses, materials, system design, and work products, is the property of PitchWizard. This includes all intellectual property developed or used within the platform, including system code. Unauthorized use, reproduction, downloading, or distribution of PitchWizard’s content is strictly prohibited.
8.2 Copyright and Trademark
- All trademarks, logos, and service marks displayed on the platform are the property of their respective owners. You must not use them without the owner’s written consent.
9. Content Management
9.1 Right to Modify
- We reserve the right to modify or discontinue any course or program offering at any time without notice. We will make reasonable efforts to inform you of significant changes affecting your subscription.
9.2 Effect on Users
- Users will not be entitled to refunds for courses discontinued after the start of their subscription period, but may receive credit towards other courses if applicable.
9.3 Third-Party Content
- Our platform may include links or access to third-party content. We do not endorse or assume responsibility for any third-party content. Interaction with third-party content is at your own risk.
10. Disclaimers

- PitchWizard is provided “as is” without warranties of any kind, either express or implied. We do not guarantee that the platform will be error-free or uninterrupted.

- The content provided on PitchWizard is for educational purposes only and does not constitute professional advice. Users should seek professional advice where applicable.
11. Limitation of Liability
11.1 Liability Cap
- For individuals our liability is limited to the unrecognised revenue balance (revenue backlog) less any non-refundable fee’s on your account from the time of first payment to the date of the event giving rise to the claim.

12. Indemnification
- You agree to indemnify and hold PitchWizard, its affiliates, officers, agents, and employees harmless from any claims, damages, liabilities, and expenses arising out of your use of the platform, your violation of these terms, or your infringement of any third-party rights.
13. Modifying or Terminating Services
- We may add, remove, or modify features of our services at any time. In the event of termination of services, users will be notified, and any applicable refunds will be handled in accordance with our Refund Policy.
14. Governing Law
- These Terms of Service are governed by and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law principles.
